Marblehead, MA 01945

This agent is designated solely to receive notifications of claimed infringement under the DMCA. All other inquiries, including general legal questions, should be directed to [email protected].
2. How to Submit an Infringement Notice
To be effective under 17 U.S.C. § 512(c)(3), your written notification of claimed infringement must include all of the following:
- A physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit Field Assembly to locate the material (such as a URL or other specific location within our services).
- Information reasonably sufficient to permit Field Assembly to contact you as the complaining party, such as an address, telephone number, and, if available, an email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please send your notice to the designated agent at the address or email listed in Section 1 above. Notices that do not include all of the required elements may not receive a response.
Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.
3. Counter-Notices
If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notice to our designated agent. Under 17 U.S.C. § 512(g)(3), your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Field Assembly may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of that person.
Upon receipt of a valid counter-notice, Field Assembly will forward a copy to the original complaining party and may restore the removed material no sooner than ten (10) and no later than fourteen (14) business days after receipt of the counter-notice, unless the designated agent first receives notice that the original complaining party has filed a court action seeking to restrain the allegedly infringing activity.
Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability for damages, including costs and attorneys' fees.
4. Repeat Infringer Policy
It is Field Assembly's policy, in appropriate circumstances and at Field Assembly's discretion, to disable and/or terminate the accounts of users who are repeat infringers or who are repeatedly charged with infringement. Field Assembly reserves the right to terminate any user's access to our services for any reason, including for repeated copyright infringement.
5. Limitations on Liability
Field Assembly's safe harbor protection under 17 U.S.C. § 512 is contingent upon Field Assembly complying with the notice and takedown procedures set forth in the DMCA. Field Assembly does not endorse any content posted by its users and expressly disclaims any liability for copyright infringement by its users. Allegations of copyright infringement must be submitted in accordance with this policy to receive a timely response.
